        be disputed or verified. The citizen must not suffer any disadvantages as a result of this

        commitment.

                                                             § 3
                                        Ancestral settlement area of the Sorbs/Wends

        (1)  The right of the Sorbian/Wendish people to protect, preserve and maintain their ancestral

        settlement area is guaranteed. The special character of the ancestral settlement area of the
        Sorbs/Wends (hereinafter: ancestral settlement area) and the interests of the Sorbs/Wends are to
        be taken into account when shaping state and local policy.


        (2)  For the purposes of this law, ancestral settlement area means the district-free city of
        Cottbus/Chóśebuz as well as those municipalities and parts of municipalities in the districts of

        Dahme- Spreewald, Oberspreewald-Lausitz and Spree-Neiße/Sprjewja-Nysa in which a continuous
        linguistic or cultural tradition can be proven up to the present. Specifically, the ancestral settlement
        area at the time of the entry into force of the Act Amending Legislation on the Rights of the
        Sorbs/Wends in the State of Brandenburg of February 11, 2014 (GVBl. I No. 7) the municipalities

        and parts of municipalities specified in the Annex to this Act.

        (3)  Changes in municipal affiliation do not result in a departure from the ancestral settlement area.
        In the case of mergers of municipalities, an affiliation of one of the previous municipalities to the

        ancestral settlement area shall result in the continued affiliation of this resulting part of the
        municipality to the ancestral settlement area. If, in the course of a mining-related resettlement of
        inhabitants of a municipality or part of a municipality belonging to the ancestral settlement area, no

        suitable resettlement area can be offered in the ancestral settlement area pursuant to Section 3 of
        the Act on the Promotion of Lignite in the State of Brandenburg, the ancestral settlement area shall
        be extended by the resettlement area.


        (4)  The geographical scope for area-related measures for the protection and promotion of the
        national identity of the Sorbs/Wends is determined by the ancestral settlement area. In individual
        cases, the Ministry responsible for Sorbs/Wends affairs may, upon application of a municipality and
        after hearing the respective administrative district and the Council for Sorbs/Wends Affairs at the

        Landtag, grant temporary exemptions from area-related measures. The time limit shall not exceed
        the period of four years after joining the ancestral settlement area pursuant to Section 13c (1).


                                                             § 4
                                                    Sorbian/Wendish flag

        The Sorbian/Wendish flag has the colors blue, red, white. It can be used on an equal footing with
        state symbols.


                                                            § 4a
                Umbrella organizations of Sorbian/Wendish associations and societies - right to sue associations

        (1)  The interests of the Sorbian/Wendish people and the citizens of Sorbian/Wendish ethnicity can

        be represented at the state and municipal level by a recognized umbrella organization of
